Legal & Validity
Yes. A Living Will is legally an Advance Medical Directive (AMD). It was recognised by the Supreme Court of India in Common Cause v. Union of India (9 March 2018) as part of the right to die with dignity under Article 21, and the procedure was simplified on 24 January 2023. A properly executed directive is enforceable across India.
No. A Living Will permits passive euthanasia — the withdrawal or withholding of life-sustaining treatment when there is no reasonable hope of recovery. It does not permit active euthanasia or assisted suicide, which remain illegal in India. It is about allowing a natural death with dignity, not causing death.
The executor signs the directive before two independent witnesses, and it is attested by a notary or a gazetted officer. The earlier requirement of a Judicial Magistrate countersignature was removed in 2023. The directive names a guardian, is revocable, and a medical board with defined timelines oversees implementation.
A property will distributes your assets after death and is governed by the Indian Succession Act. A Living Will directs your medical care while you are alive but unable to speak for yourself, and is governed by the Supreme Court's 2018 ruling. They are completely separate documents — and you may want both.

Your Living Will names a guardian (a trusted person) who is authorised to communicate and uphold your documented wishes. When the directive is to be acted upon, a medical board reviews the situation within defined timelines before any decision to withhold or withdraw treatment is implemented.
Most families complete the process in 2–3 sessions over 1–2 weeks. We never rush you. In urgent situations — for example a recent terminal diagnosis — we can expedite significantly.
Keep it somewhere known and accessible, and give copies to your guardian, your doctor, and close family. We provide certified copies and guidance on registering the document with the relevant authority.
Without one, doctors are generally obliged to provide every available intervention, and decisions fall to your family under stress — which can mean unwanted, expensive treatment and painful disagreements. A Living Will prevents this.
